He Federal Electoral Tribunal (TEPJF) determined that if the Governor of Yucatán, Mauricio Vila Dosalintends to continue with his aspiration for a seat in the Senate of the Republic for the PAN, must be removed from office in a period of no more than 10 days.
The judges of the Superior Chamber of the TEPJF considered that Vila Dosal is in omission of the criteria of the country’s highest court on electoral matters, so if he continues with his aspiration, he must resign.
The Chamber indicated that the governor is head of the public force in the districts of Yucatan where the senatorship will be elected based on the principle of proportional representation to which it aspires.
The judges explained that article 55 of the federal Constitution establishes that, in these cases, the candidate for the disputed position must leave office at least 90 days before the election.
They specified that because that deadline has already been exceeded, by far, an almost immediate separation is necessary. For this reason, they gave a reasonable period of 10 days from the notification made to the representative of the sentence.
The decision was made based on the challenge filed by a citizen against the governor’s failure to resign from office. The draft sentence was in charge of Judge Mónica Aralí Soto Fregoso.
The only one who voted against the decision was Judge Janine Otálora Malassiswho estimated that this case could not be analyzed because the claim “does not satisfy one of the admissibility requirements,” since the citizen who filed the complaint lacks legal interest to challenge the aforementioned omission.
Governor of Yucatán says he is waiting for notification from the TEPJF to comply with it
Through a press release, the government of Yucatán headed by Mauricio Vila Dosal reported that is awaiting notification of the sentence of the Electoral Tribunal to know its scope and comply with it.
Vila, who appears on the list for the Senate of the Republic via plurinominalsaid that he will remain respectful of the law and noted that he is focused on working full time for the Yucatecans.
