Far-right blogger Allan dos Santos had access to the cell phone number of Federal Supreme Court (STF) minister Alexandre de Moraes, in mid-November 2022, and tried to call the magistrate with the aim of intimidating him during a broadcast live to your followers on social media. The record is contained in a decision by the Superior Electoral Court (TSE), signed by the auxiliary judge of the Presidency Marco Antonio Martin Vargas, where Moraes holds the position of president.

The information is part of the list of documents leaked this Wednesday, 17th, by representatives of the Republican party of the United States who are part of the Justice Committee of the House of Representatives.

The order also mentions that Allan intentionally disclosed the minister’s number during the attempt to contact him. The incident was identified by the TSE’s Special Advisory for Combating Disinformation. The case report mentions that the disclosure of Moraes’ data “resulted in the receipt of several calls and messages of an offensive and threatening nature, putting the personal safety of the minister and his family at risk.”

“Based on the facts reported, there is irregular sharing of personal data with the unequivocal purpose of transferring, to the person of the minister president, institutional attacks based on disinformation that affect the integrity of the electoral process, with the immediate objective of foment anti-democratic protests that aim to cause a constitutional rupture, through federal or military intervention”, said judge Martin Vargas in the order.

The exposure of Allan’s actions was accompanied by an order for the social network Instagram to remove, within a maximum period of two hours, the profile created by the blogger to perform the live, under penalty of a fine of R$150,000. It was also determined that X (formerly Twitter) removed the publication of an account that transmitted the attacks on the minister.

The document states that the rapporteur of the process was Minister Moraes himself and that the interested party in the decision would be the TSE – that is, the magistrate would have instructed the process of which he was a victim. Furthermore, the decision came from one of his assistant judges in the TSE Presidency’s office. The decision is included in the list of confidential documents released by North American parliamentarians in the wake of the conflict between Moraes and the billionaire owner of platform X, Elon Musk.

According to the STF, the documents released by US deputies are not the reasoned decisions that determined the removal of content or profiles, but rather the letters sent to the platforms to comply with the decision. “All decisions taken by the STF are justified, as provided for in the Constitution, and the parties, the people affected, have access to the reasons”, informed the Supreme Court, in a note.
