MPRJ denounces civil police officers and delegate for participating in a criminal scheme | Rio de Janeiro

Rio – The Public Ministry of the State of Rio de Janeiro (MPRJ) denounced five civil police officers, including a delegate, for the crimes of concussion and insertion of false data in the Civil Police information system. According to investigations, the agents were part of a scheme to receive undue advantages to avoid arresting criminals in the act.

The complaint, made in the middle of this month, is an outcome of the investigations that led to the two phases of the Operation Fourth Elementcarried out by the Specialized Action Group for Combating Organized Crime (Gaeco) of the MPRJ in 2017 and 2018. The organization also requested, together with the 2nd Criminal Court of Santa Cruz, the loss of the position of the police officers, whose identities were not revealed.

According to investigations carried out by the Civil Police General Inspectorate, the crimes occurred in 2017, within the 36th DP (Santa Cruz), in the West Zone of Rio, with the participation and connivance of the chief delegate at the time of the events, Rodrigo Sebastian Santoro Nunes.

The investigation found that the criminal group had the participation of police officers and people outside the corporation, known as “X-9”, responsible for gathering information about possible targets. Once the victims were identified, the accused agents simulated a police action and, based on the identification of irregularities, demanded the receipt of undue advantages in order to stop arresting them in the act.

In the criminal action, MPRJ prosecutors described a case in which police officers demanded the payment of R$10,000 to avoid registering an incident of arrest. At the time, the agents allowed the victim, a trader, to hand over the amount in two installments of R$5,000, and he was released so he could withdraw the first installment. One of the police officers was responsible for collecting the remaining amount, which was paid in two more installments. The amounts were divided between the police officers reported.

To cover up the extortion at the time, one of the police officers recorded the incident, which had in his “order” the suspension of the procedure due to the atypical nature of the conduct, under the justification that receipts for the products had been presented.

Remember the operation

Six people, including four civil police officers, were arrested in the act for participating in the criminal group in September 2017 during the first phase of Operation Fourth Element. According to the complaint, the agents used vehicles, badges and the police structure to carry out the crimes.

At the time, police officers Carlos Tadeu Gomes Freitas Filho, Xavier Fernandes Coelho, Rafael Ferreira dos Santos and Delmo Fernandes Baptista Nunes and informants Fábio Rodrigo da Silva and Raphael Nonato dos Santos Lopes, known as Longo, were arrested. 19 search and seizure warrants were also executed, two of which were carried out in police units.

The group was denounced for having constituted, integrated and promoted a criminal organization with the aim of obtaining economic advantages through the practice of countless crimes of concussion, extortion through kidnapping, usurpation of public functions and corruption.

In 2018, in the second phase of the operation, another 48 people were reported, including police chiefs, civil police officers, military firefighters and military police officers. All were arrested for participating in the scheme.
At the time delegate, Rodrigo Santoro was appointed as leader of the gang. He worked at the Cartorário Collection Police Station (Capital) when he was arrested, but has already been assigned to the 34th DP (Bangu), 35th DP (Campo Grande), 36th DP (Santa Cruz), Child and Adolescent Protection Police Station (DPCA) of Niterói and at the Robbery and Theft Police Station (DRF). In 2022, he was sentenced to 16 years and four months in prison, in addition to the loss of his position as a delegate.

How the scheme worked

For the Public Ministry, the group was united around a common objective: to identify people who were outside the law, their economic potential and carry out police “operations” against them, always with the intention of catching them in the act commenting on some type of crime. After that, they demanded a large amount of money so that the suspects would not be arrested or the goods would be seized.

The investigation identified that anyone who practiced something illegal could be a victim of the gang. The MPRJ found cases of extortion against sellers of pirated goods, street vendors, gas stations, bingo halls, owners of cloned vehicles and illegal traders.

According to the agency, the gang even made threats and even physically attacked the victims. The gang also diverted the seized materials to be resold.

Rodrigo Santoro and retired civil police officer Delmo Fernandes were accused of being “high-ranking” and managing, monitoring and receiving the profits obtained by the criminal and financial scheme produced by the other members of the organization. Like Santoro, Delmo was sentenced in 2022 to 53 years in prison.

The scheme to collect illicit benefits began in the 34th DP, in Bangu, but with the transfers of the police officers involved, it began to be carried out in the 36th DP (Santa Cruz) and, later, in the Police Station for the Protection of Children and Adolescents (DPCA) in Niterói.
