Pacheco defends restriction of the Quinquênio PEC and debates with government on career inclusion | Brazil

The president of the Senate, Rodrigo Pacheco (PSD-MG), defended this Tuesday, 7th, in an interview with Globonews, that the proposed amendment to the Constitution (PEC) that grants an additional benefit to judges, prosecutors and other careers at the top of the public service is restricted. The proposal, known as the Quinquenium PEC, was approved by the Constitution and Justice Commission (CCJ) and is in the discussion phase in the Senate plenary.

Pacheco defended “caution” in the discussion on the subject and that the inclusion of new categories, especially those linked to the Executive Branch, be negotiated with the government and have an estimated fiscal impact.

“We are going to be cautious. What caused more concern on the part of the Executive, with the extension to other careers that matter to the Executive and that we can generate a cascade effect on the states. We will be careful with this. It is not possible, in fact, by amendments, to include careers without a budgetary impact study, without dialogue with the Executive, who will pay”, he said.

The Ministry of Finance estimates that the annual cost of the grant granted to members of the Judiciary and the Public Ministry could reach R$40 billion. Planalto is negotiating with the Senate the possibility of changing the text, restricting the categories that will benefit or removing retirees from the list of recipients.

The president of the Senate emphasized, however, that this debate has already been held with the Judiciary — responsible for magistrates, for example. “Now, the PEC on judges and prosecutors has already been discussed for years with the Judiciary”, defended Pacheco.

According to the senator, it is necessary to recognize the importance of careers in the Public Ministry and the Judiciary. According to him, the combination of the Quinquennium PEC and the end of super salaries will mean savings for public coffers. He further argued that, “in authoritarian regimes, the first to be attacked are judges”, as a way of defending career advancement for these civil servants.

Pacheco is the author of the PEC, which provides for the return of Additional Payment for Time of Service (ATS) for categories every five years. The text establishes a 5% increase in salaries each period, which can reach a maximum of 35%.
