Paula defended her thesis on this topic through her experience as a lawyer, through her studies and research after realizing that for centuries families were formed for reasons other than love, freedom and affection. “Reflecting on the area of Law, it was imposed, imposed and separated from any value and principle”, she highlights.
In relation to Family Law, with the Post-Positivist Movement, from the 20th Century onwards, new legal readings became possible with the constitutionalization of Civil Law, breaking classic paradigms in the family area.
Paula recalls that in Brazilian Law, the Federal Constitution inaugurated a dispersion of principles and values that should guide the rights of families, followed by the Civil Code and, currently, by the jurisprudence of the Superior Courts that recognize affection as a primary reason, as well as accepting the Principle of Affection, as being the building link of family relationships.
The book addresses the principles of the Law of new family demands. “Undoubtedly, the need to make effective the formation of a dignified society that sees the family nucleus as a source of loving relationships. highlights Paula.
In this new social universe, the author questions whether there is, nowadays, a more intrinsic value than affection in family law. And most importantly, she states: its lack brings inevitable legal consequences that are discussed in the courts.
Paula Caldeira records the message in her book and hopes that the principle of affection and affection are expressly recognized, providing and making happiness and dignity possible for the human person in all family relationships, positive or not.
