Police conclude investigation and request arrest of Porsche driver for the 3rd time | Brazil

The São Paulo Civil Police concluded the investigation investigating the accident involving a Porsche in the early hours of March 31 and requested for the third time the arrest of the driver of the luxury car, businessman Fernando Sastre de Andrade Filho, aged 24. The collision of the vehicle with the rear of a Renault Sandero caused death of app driver Ornaldo da Silva Viana, 52 years old. The accident happened on Avenida Salim Farah Maluf, in Tatuapé, in the East Zone of the capital of São Paulo.

Previously, two other requests for arrest (one temporary and the other preventive) were denied by the courts. When contacted, Andrade Filho’s defense did not speak out until the last update of this report.

The Public Security Secretariat informed, in a note, that the 30th Police District (Tatuapé) concluded the investigations into the case and reported the police investigation to the Court this Wednesday, 24th, with a new request for the author’s preventive detention. Now, the Judiciary will decide whether or not to arrest the driver.

The businessman was being investigated for the crimes of homicide, bodily harm — due to the injuries caused to the friend who was with him in the car — and fleeing the scene of the crime (he did not provide assistance and did not take a breathalyzer).

In addition to Viana’s death, the accident resulted in hospitalization of student Marcus Vinicius Rocha22 years old, who underwent a surgical procedure to remove his spleen.

Another point is that the accident was recorded in the early hours of Easter Sunday, but Andrade Filho reported to the 30th DP almost 40 hours after the incident, on April 1st — the same day that Viana was buried in Guarulhos, in Greater São Paulo .

At the time, Andrade Filho’s defense denied that the client had fled the scene of the accident and stated that he was merely “protecting himself from lynching.”

With the conclusion of the investigation, it is up to the Public Ministry of the State of São Paulo (MP-SP) to decide whether to indict Andrade Filho for the three crimes, in addition to agreeing or not with the new arrest request. Recently, the agency reported that it requested 3D scanning expertise to elucidate the accident in detail.

As Estadão showed, the Porsche 911 Carrera GTS driven by businessman Andrade Filho was traveling at 156 km/h shortly before the accident that killed the Viana app driver, according to a report from the Technical-Scientific Police. The speed represents more than triple the 50 km/h allowed for Avenida Salim Farah Maluf, where the collision occurred.

According to an investigation by the Military Police, the agents who responded to the incident erred by not performing a breathalyzer test on Andrade Filho after the accident. “Witnesses say that he had a slurred voice and a staggering gait”, said, on the 6th, delegate Carlos Henrique Ruiz, from the 5th Sectional Police Station (East).

One of the points that supported the last request for arrest, made by the Civil Police at the time of the police chief’s statement, is that Andrade Filho appeared to be “altered” that morning, according to witnesses interviewed during the investigation. He had just left an “open bar” party (with drinks allowed) when he was involved in the accident.
