Will Harvey Weinstein get out of jail? This continues for the producer of ‘Kill Bill’ after the conviction is annulled – El Financiero

The decision of the highest court of New York to annul the conviction for rape of the movie mogul Harvey Weinstein has reopened a painful chapter in the America’s Reckoning with sexual misconduct by powerful figures, an era that began in 2017 and helped launch the #MeToo movement.

Below some key points about the case and what will happen next with the American producer, who has around 300 credits on films like Shakespeare in Love (1998), The Lord of the Rings: The Fellowship of the Ring (2001), Kill Bill (2003) and The eight most hated (2015).

What happened to Harvey Weinstein’s sentencing?

The New York Court of Appeals ruled that the trial judge in the rape case prejudged Weinstein with “egregious” inappropriate rulingsincluding the decision to allow women to testify about allegations for which Weinstein was not being prosecuted.

In its 4-3 decision, the court majority said it was a “abuse of judicial discretion” that Judge James Burke would allow testimony from those other women about “alleged improper, repugnant acts and despicable behavior.”

“Without a doubt, this is appalling, disgraceful and repulsive conduct that could only diminish the defendant’s character before the jury,” they said.

He Weinstein’s lawyerArthur Aidala, had argued that Burke also influenced the trial by giving prosecutors permission to confront Weinstein, if he decided to testify, about his background.


Aidala said that Weinstein wanted to testifybut he chose not to do so because he would have had to answer questions about more than twenty alleged acts of inappropriate behavior dating back four decades, including a fight with his film producer brother, overturning a table in anger and yelling at waiters and his assistants.

Will Harvey Weinstein be released from prison?

Weinstein, 72, will remain imprisoned because he was found guilty in Los Angeles in 2022 of another rape and sentenced to 16 years in prison.

Weinstein has served his sentence in New York, most recently at the Mohawk Correctional Facility, about 100 miles (160 kilometers) northwest of Albany.

What’s next in the Weinstein case?

The Manhattan district attorney’s office has indicated that it plans to retry Weinsteinmeaning his accusers could be forced to retell their stories on the witness stand.

“We will do everything in our power to retry this case and remain steadfast in our commitment to the sexual assault survivors“prosecutors noted in a statement.

Weinstein was convicted in New York on sex crime charges involving forced oral sex on a television and film production assistant in 2006 and the rape of an aspiring actress in 2013.

Weinstein maintains his innocence and has said that all of his sexual encounters were consensual.
