Electoral Tribunal removes Francisco García Cabeza de Vaca’s candidacy for the Senate – El Financiero

The Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) threw the candidacy for the Senate of the Republic of the former governor of Tamaulipas, Francisco Javier García Cabeza de Vaca.

By majority, the magistrates resolved that By judicial resolution the political-electoral rights of the former president are suspended because against him there is at least two arrest warrants.

They also said that there is judicial evidence that García Cabeza de Vaca has evaded justice in order not to be detained so that he can legally face the accusations against him.

For this reason, the judges decided to revoke the candidacy of the former governor of Tamaulipas and They gave 48 hours to the National Action Party (PAN) to nominate the person who will replace said candidacy.

It is worth remembering that in INE/CG233/2024 the General Council of the National Electoral Institute (INE), in exercise of the supplementary power, accepted the registrations of the candidacies for deputies to the Congress of the Union by the principle of relative majority and proportional representation.

Among them, he accepted the candidacy of Francisco Javier García Cabeza de Vaca, María Teresa Castell of Oro Palacios, Gabriel Ricardo Quadri de la Torre, Olga Zulema Adams Pereyra and Julián Zacarías Curi and Esteban Abraham Macari.

This decision was challenged by Morena who asked to cancel the candidacy of García Cabeza de Vaca.

The case reached the Superior Chamber of the TEPJF and, at the proposal of Judge Janine Otálora Malassis, the Chamber decided to revoke the determination.

Reyes Rodríguez Mondragón, who voted against the project, said that García Cabeza de Vaca has suspensions of protection against arrest warrants so his political-electoral rights are not suspended.

“There is no court order that determines this, there is no electoral authority that registers it and therefore its electoral registration has been deregistered,” said Judge Rodríguez Mondragón.

He pointed out insistently that, An arrest warrant is not enough to suspend a person’s political and electoral rights. and much less to prevent his registration as a candidate for a popularly elected position.

TEPJF reverses Morena, endorses Ricardo Anaya’s candidacy

Magistrates of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) endorsed the candidacy of Ricardo Anaya Cuts, to the Senate of the Republic for the National Action Party (PAN).

By majority vote, they estimated that the suspension of the political rights of the former PAN presidential candidate and current candidate for that same party for a senatorial position is not updated.

Morena challenged the registration granted by the General Council of the INE to the Anaya candidacy for a senatorship due to the principle of proportional representation nominated in the number three place on the PAN List.

However, the magistrates said that Morena did not prove the existence of an arrest warrant, that the criminal action against him had not prescribed, nor that Anaya was removed from the action of justice.
