Morena continues with its offensive against the Judiciaryand with just under a week left until the end of the session in Congress, the ruling party bench said it is preparing a new reform with which they could revoke the invalidations of the Supreme Court of Justice of the Nation (SCJN).
Deputy Juan Ramiro Robledo Ruíz recently announced that in the next legislation they will launch the measure, which puts more obstacles to the work of the Judiciarywhich through its powers has not allowed the passage of reforms approved in the Legislative Branch such as ‘plan B’ of the electoral reform approved in February of last year.
In order that the Supreme Court, which Morena and allies have accused repeatedly to benefit businessmen and the private sector, cannot intervene with their approved reforms, they will seek a qualified majority so that their actions are blocked through the Legislature.
What would the reform of the Judicial Branch consist of?
According to deputy Robledo Ruíz, it will be sought that, whether it is the Chamber of Deputies or the Senate, Congress can “revoke the invalidity of a ruling from the Supreme Court of Justice regarding a Law.”
How would it be? The answer is that, if approved, the reform will mean that, for example, if Congress approves a constitutional reform on electoral matters and the Supreme Court declares it invalidany of the chambers, having two thirds, can revoke the decision of the Judiciary and advance the initiative until it reaches the Executive, where the President in turn could sign and allow its arrival in the Official Gazette of the Federation.
The proposal also includes an early consultation with the Supreme Court before “dictating an opinion” in order to avoid discussions about the legality or otherwise of an initiative and its vote.
“It is a different vision that we have, human rights are not violated. If the Court throws it (the initiative) it will be presented again until there is a majority of ministers who understand that the Law should not be interpreted politically,” Robledo Ruíz pointed out.
