The proposal for reforms to the Amparo Law made by Ricardo Monreal is, to say the least, a setback with respect to the protection of human rights in Mexico, since it enables the possibility that laws that are contrary to the Constitution have effects on persons who do not have the capacity or possibility of filing a claim for guarantees. But if, on the other hand, you are poor and feel that a law of Congress violates your rights and you do not have the resources to hire a lawyer to defend you with an injunction, then screw you. This situation would be the case if these reforms to the Amparo Law are approved, since, protecting the principle of relativity of amparo, they want that even if a judicial instance declares a norm as contrary to the Constitution, it continues to apply to all those who They cannot protect themselves and, in the height of cynicism and shamelessness, continue applying any law contrary to the Magna Carta.

I was listening to a senator named Israel Zamora on the radio—who seemed like a tremendous fraud—who defended this proposal based on totally populist ideology and demagoguery, saying that it cannot be that a judge suspends the application of a general rule dictated by a Democratically elected Congress. Does this senator really believe that because they are elected, all their trickery and their acts of ignorance should be validated? Does he really believe that legislators know about constitutional law simply by being elected by popular vote? It seems that he does believe it or at least that is what is understood from his interventions.

Now, the background of the matter is that the 4T is not happy with constitutional control in general, it seems that the Constitution hinders them and since they cannot reform it, they look for a way to get around it to take away citizens’ rights, finally the president’s popularity is not tarnished.

It is a very serious moment for constitutional control and the defense of human rights, since the Morena parliamentary group knows that there are protections that take years to be resolved in terms of substance and it is based on this that federal judges can decree suspension of laws that in their opinion may violate the Constitution to prevent them from affecting citizen rights. Both Monreal and Zamora know it, they are both lawyers, but they pretend that the Virgin is speaking to them and they are sacrificing the protection of citizens’ rights for possibly unconstitutional norms, with the sole purpose of violating – even for a little while – fundamental rights. of those who cannot hire lawyers to file an amparo.
